A Montgomery man has been sentenced to 30 months in federal prison for illegally possessing a machinegun, according to an announcement from Acting United States Attorney Kevin Davidson. Alazavia Devontae Berry, 23, received his sentence on August 19, 2025. After serving his prison term, Berry will be under supervised release for three years. Federal inmates are not eligible for parole.
Court records show that the incident occurred on September 8, 2024. Members of the Metro Area Crime Suppression (MACS) Unit attempted to stop a vehicle in Montgomery due to a traffic violation. The driver, later identified as Berry, did not comply and led officers on a high-speed chase through a residential neighborhood. Berry abandoned the moving vehicle, which collided with the exterior of a nearby home, and then tried to escape on foot. Officers apprehended him and found a firearm equipped with a machinegun conversion device concealed in his clothing.
Berry pleaded guilty to illegal possession of a machinegun on April 11, 2025.
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Alabama Law Enforcement Agency, and Montgomery Police Department conducted the investigation as part of the MACS Unit. Assistant United States Attorney Paul Markovits prosecuted the case.
"There is no parole in the federal system," said Acting United States Attorney Kevin Davidson.
